By purchasing, possessing, fitting, molding, or using any Jaw Tech product, you acknowledge that you have read, understood, and agreed to this Legal Notice, the product instructions, safety warnings, contraindications, Terms of Service, and all other policies provided by Jaw Tech.

Use at Your Own Risk

Jaw Tech products are used at the sole discretion and risk of the purchaser and user.

You are responsible for determining whether the product is appropriate for you, using the product only as instructed, following all warnings and contraindications, and discontinuing use if you experience pain, breathing difficulty, injury, or other adverse effects.

Jaw Tech does not guarantee that any product will be suitable for every individual.

Information provided by Jaw Tech, including information appearing on our website, packaging, advertisements, product instructions, social media, emails, or other materials, is provided for general informational purposes only.

Nothing provided by Jaw Tech is intended to constitute medical, dental, orthodontic, diagnostic, or other professional healthcare advice.

Jaw Tech does not diagnose, treat, cure, or prevent medical or dental conditions through information provided on its website or marketing materials.

If you have questions regarding your teeth, jaw, bite, temporomandibular joint, breathing, sleep, or other health concerns, you should consult an appropriately licensed healthcare professional before using the product.

Assumption of Risk

You acknowledge that use of an oral appliance may involve risks, including but not limited to temporary or persistent dental discomfort, tooth movement, changes in bite or occlusion, jaw or temporomandibular joint discomfort, gum irritation, excessive salivation, dry mouth, difficulty breathing through the mouth, gagging, fitting problems, or other adverse effects.

By purchasing and using a Jaw Tech product, you knowingly and voluntarily assume the risks associated with its use, except to the extent such risks or liabilities cannot legally be assumed or waived.

Proper Use

Jaw Tech is not responsible for injuries, losses, damages, or other consequences resulting from misuse, improper molding, improper fitting, modification, excessive use, failure to follow instructions, use contrary to warnings or contraindications, use by an unauthorized individual, or use for a purpose other than the purpose described in the accompanying instructions.

Do not use Jaw Tech products if the instructions or warnings state that the product is unsuitable for you.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, Jaw Tech products and related information are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by law, Jaw Tech disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

Jaw Tech does not warrant or guarantee any particular cosmetic, aesthetic, structural, dental, orthodontic, medical, health, or other result from use of its products.

Limitation of Liability

To the fullest extent permitted by applicable law, Jaw Tech, its owners, members, officers, employees, contractors, affiliates, suppliers, manufacturers, distributors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the purchase, possession, fitting, use, misuse, inability to use, or performance of a Jaw Tech product.

This includes, without limitation, loss of income, loss of profits, loss of opportunity, loss of data, emotional distress, or other consequential losses.

To the fullest extent permitted by applicable law, Jaw Tech's aggregate liability arising from or relating to a product or transaction shall not exceed the amount actually paid by the customer to Jaw Tech for the specific product giving rise to the claim.

Third-Party Manufacturing and Services

Jaw Tech may use third-party manufacturers, fulfillment providers, carriers, payment processors, and other service providers.

To the fullest extent permitted by law, Jaw Tech is not responsible for acts, omissions, delays, service interruptions, or other conduct of independent third parties that are outside Jaw Tech's reasonable control.

Customer Representations

By purchasing or using the product, you represent that you are at least 18 years old and that you have reviewed the product's instructions, contraindications, warnings, and intended use before use.

You agree not to use the product if any stated contraindication applies to you.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Jaw Tech and its owners, members, officers, employees, contractors, affiliates, suppliers, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your misuse of the product, violation of the instructions or warnings, unauthorized modification of the product, violation of these Terms, or violation of applicable law.

Rights That Cannot Be Waived

Nothing in this Legal Notice is intended to exclude, restrict, or limit liability, warranties, consumer protections, remedies, or other rights that cannot legally be excluded, restricted, limited, or waived under applicable law.
